By accessing our website, creating an account, applying as a tutor, finding a tutor, booking a tutoring session, communicating through our platform, or using any Tutera Learning service, you agree to these Terms and Conditions and our Privacy Policy.

If you do not agree with these Terms, please do not use Tutera Learning.

1. About Tutera Learning

Tutera Learning is an online educational platform that helps students, learners, parents, and guardians connect with tutors and access tutoring services.

Our platform may facilitate tutor discovery, profile viewing, scheduling, communication, tutoring arrangements, payments, and other services related to tutoring.

Tutera Learning may provide tools and technology that support interactions between students and tutors. Unless expressly stated otherwise, tutors provide their tutoring services independently and are responsible for the teaching services they offer.

Tutera Learning does not guarantee a particular academic grade, test score, educational outcome, or learning result from any tutoring session.

Tutor profiles, qualifications, experience, availability, rates, and other information are provided for informational purposes. Users should consider the information available and make their own decisions when selecting a tutor.

2. Eligibility and Account Requirements

To use certain Tutera Learning features, you may need to create an account.

By creating an account, you agree to:

  1. Provide accurate, complete, and current information.
  2. Keep your login credentials confidential.
  3. Update your information when necessary.
  4. Use only your own account.
  5. Notify us promptly if you believe your account has been accessed without authorization.
  6. Follow these Terms and all applicable laws.

Tutor minimum age: 18 years

Students under 18 should use Tutera Learning with the involvement and consent of a parent or legal guardian where required by applicable law.

Parents and guardians are responsible for supervising minors' use of the platform and for bookings or payments made on their behalf where applicable.

Tutera Learning may request additional information to verify an account or protect the platform from fraudulent or unauthorized activity.

3. Tutor Accounts and Profiles

Tutors may create profiles that allow students to learn more about their tutoring services.

Tutor profiles may contain:

  1. Name
  2. Profile photograph
  3. Biography
  4. Education and qualifications
  5. Teaching experience
  6. Subjects
  7. Courses
  8. Languages
  9. Rates
  10. Availability
  11. Teaching location or service options
  12. Other professional information provided by the tutor

Tutors are responsible for ensuring that information provided in their profiles is accurate and not misleading.

Tutors must not claim qualifications, certifications, professional experience, licenses, or teaching credentials that they do not possess.

Tutors are responsible for maintaining any professional licenses, permits, certifications, insurance, or other requirements applicable to the services they provide.

Tutors must also comply with applicable tax and legal obligations relating to their tutoring activities.

4. Students and Learners

Students may use Tutera Learning to search for tutors, review tutor profiles, communicate with tutors, and arrange tutoring services.

Students agree to:

  1. Provide accurate information.
  2. Select tutors based on their own educational needs.
  3. Provide reasonable information about the subject or support they require.
  4. Attend scheduled sessions on time.
  5. Communicate respectfully with tutors.
  6. Make required payments.
  7. Follow these Terms and applicable laws.

Parents or guardians may assist with account management, scheduling, payments, and communication for minors.

5. Tutoring Services

Tutera Learning provides access to tutoring options that may be available online, in person, or through other arrangements shown on the platform.

Tutoring subjects may include academic, professional, test-preparation, language, technology, career-support, and other educational areas offered through the platform.

The availability of a particular subject, tutor, location, schedule, or service may change.

Tutoring sessions are subject to the availability and terms displayed when the service is arranged.

Tutera Learning does not guarantee that a particular tutor will remain available or that a particular tutoring arrangement will continue indefinitely.

6. Tutor Selection and Booking

Where Tutera Learning provides booking functionality:

  1. A student reviews available tutor profiles.
  2. The student selects a tutor, subject, date, time, or other available option.
  3. The applicable price is displayed before the booking is confirmed.
  4. The student submits or confirms the booking request.
  5. The tutor may accept, reject, or otherwise respond to the request depending on the available platform functionality.
  6. Once confirmed, the tutoring session will be scheduled according to the booking details.

The exact booking process may vary depending on the service or platform features available at the time.

Tutera Learning may send booking confirmations, reminders, updates, or cancellation notices by email, through the platform, or through other available communication methods.

7. Pricing and Payments

Tutera Learning may offer hourly tutoring sessions and package options. Prices may vary based on the tutor, subject, session duration, package, and other factors displayed before purchase.

Before confirming a paid service, users will be shown the applicable price where the platform supports online payment.

Where applicable:

  1. You authorize the applicable payment provider to process your payment.
  2. Prices may be subject to applicable taxes.
  3. Third-party payment processing fees may apply.
  4. Payment information may be processed by a third-party payment provider.
  5. You are responsible for providing accurate billing information.
  6. We may restrict or suspend transactions where fraud, unauthorized activity, or payment problems are suspected.

Tutors are responsible for providing accurate payout information where Tutera Learning offers tutor payouts.

8. Tutor Fees, Memberships, and Platform Charges

If Tutera Learning requires tutors to pay a membership, subscription, commission, listing fee, or other platform charge, the applicable amount and payment terms will be displayed before the tutor purchases or activates the relevant service.

Tutor membership fee: $50 per month

Platform commission: Determined by Tutera Learning and adjustable through the admin portal

Where a subscription renews automatically, the renewal terms will be disclosed before purchase.

Tutors may cancel recurring subscriptions according to the cancellation instructions provided by Tutera Learning or the applicable payment platform.

Subscription fees already paid are generally non-refundable except where required by applicable law or the applicable payment provider's policies.

Tutera Learning may change its fees by providing notice where required by law or the applicable agreement.

9. Cancellations and Refunds

Cancellation and refund rules may vary depending on the tutoring service, package, booking, or payment method.

Unless a different policy is displayed at the time of purchase:

Student cancellations:  Full refund if cancelled more than 24 hours before the scheduled session; 50% refund if cancelled between 12 and 24 hours before the session; no refund if cancelled less than 12 hours before the session.

Tutor cancellations: Full refund to the student.

Tutor no-shows: Full refund to the student.

Student no-shows: No refund.

Technical problems:  Full or partial refund after review of the circumstances.

Where a refund is approved, it will generally be issued through the original payment method, subject to the payment provider's processing times.

Refunds may take 5–10 business days to appear after they are processed.

Nothing in these Terms limits any consumer rights that cannot legally be excluded.

10. Disputes Between Students and Tutors

If a student believes that a tutoring session did not occur as agreed or there is another legitimate issue with a tutoring service, the student should contact Tutera Learning as soon as possible.

Dispute submission period: 7 days after the scheduled session

A dispute may include:

  1. A description of the issue.
  2. Booking information.
  3. Relevant communications.
  4. Supporting documents.
  5. Other evidence reasonably related to the dispute.

Where appropriate, Tutera Learning may request information from both the student and tutor.

Tutera Learning may review the available information and determine what platform action is appropriate under the circumstances, including where applicable:

  1. Issuing a refund.
  2. Releasing or withholding a payment.
  3. Adjusting a transaction.
  4. Asking the parties to resolve the matter directly.
  5. Restricting an account.
  6. Taking action under these Terms.

Tutera Learning's platform decision does not prevent a user from exercising rights available under applicable law.

Submitting knowingly false information or fabricated evidence may result in account restrictions or termination.

11. Acceptable Use Rules

You agree to use Tutera Learning responsibly and respectfully.

You must not:

  1. Harass, threaten, bully, stalk, intimidate, or abuse another person.
  2. Discriminate against another user based on protected characteristics.
  3. Engage in sexually inappropriate conduct through the platform.
  4. Engage in sexual conduct, grooming, solicitation, exploitation, or other inappropriate behavior involving a minor.
  5. Impersonate another person.
  6. Provide false qualifications, credentials, identity information, or professional claims.
  7. Create fraudulent or misleading tutor profiles.
  8. Use another person's account without authorization.
  9. Share another person's private information without permission.
  10. Request unnecessary sensitive financial or personal information from another user.
  11. Use the platform to arrange unlawful activities.
  12. Attempt to bypass applicable platform fees or protections by moving transactions outside the platform where prohibited.
  13. Spam, advertise unrelated products or services, or send unsolicited promotional content.
  14. Upload malware, malicious code, or harmful files.
  15. Attempt to gain unauthorized access to accounts or platform systems.
  16. Scrape, copy, collect, or misuse platform data without authorization.
  17. Reverse engineer or interfere with the operation of the platform except where permitted by law.
  18. Use Tutera Learning to facilitate academic cheating, plagiarism, examination fraud, or other academic misconduct.
  19. Upload or share copyrighted educational materials without the necessary permission.
  20. Upload content that infringes another person's intellectual property, privacy, or other rights.
  21. Promote illegal goods, services, or activities.
  22. Use the platform for fraud or deceptive conduct.
  23. Share content that encourages dangerous or unlawful behavior.
  24. Offer services unrelated to education or tutoring without our authorization.

Tutera Learning may take action against accounts that violate these rules.

12. Safety and Protection of Minors

Tutera Learning takes user safety seriously.

Users must not use the platform to:

  1. Groom or exploit minors.
  2. Request inappropriate photographs or personal information from minors.
  3. Arrange inappropriate private interactions with minors.
  4. Engage in sexual or abusive conduct involving minors.
  5. Encourage minors to move communications to unsafe or unauthorized channels.

Any suspected exploitation, abuse, grooming, or other serious safety issue may be reported to appropriate authorities where required or permitted by law.

Parents and guardians should remain involved in a minor's use of tutoring services where appropriate.

Users should avoid sharing unnecessary sensitive personal information through tutor profiles, chat, tutoring sessions, or other platform features.

13. User Content

Users may be able to submit profiles, photographs, reviews, messages, documents, educational materials, and other content through Tutera Learning.

You retain ownership of content you lawfully own and submit.

By submitting content to Tutera Learning, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, process, and transmit that content as reasonably necessary to operate, maintain, secure, and provide the Services.

You represent that:

  1. You have the right to submit the content.
  2. Your content does not unlawfully infringe another person's rights.
  3. Your content does not violate these Terms.
  4. Your content does not contain unlawful or malicious material.

We may remove content that violates these Terms, applicable law, or our safety requirements.

14. Reporting and Moderation

If you encounter content, conduct, or a user that appears to violate these Terms, please report the matter to us.

  5. Suspend an account.

We may take immediate action when necessary to address serious safety, security, fraud, or legal concerns.

15. Online Sessions and Third-Party Services

Where tutoring sessions are conducted through a third-party video, communication, or other service, users may be required to comply with that provider's terms and privacy policy.

Users must not share session links with unauthorized individuals.

Tutera Learning is not responsible for outages, interruptions, technical failures, or changes to third-party services that are outside our reasonable control.

16. Tutor Qualifications and Verification

Tutors are responsible for providing accurate information regarding their education, qualifications, experience, certifications, and teaching abilities.

Tutera Learning may review tutor applications or profiles according to its internal processes.

Verification process: Tutera Learning does not independently verify tutors or conduct background checks. Tutors upload their own certifications, which are not independently verified by Tutera Learning.

Unless expressly stated otherwise, users should not assume that Tutera Learning has independently verified every statement contained in a tutor's profile.

Students and parents should review available tutor information and make appropriate decisions regarding the suitability of a tutor.

17. Intellectual Property

The Tutera Learning name, website, platform design, logos, graphics, software, text, and other original materials provided by Tutera Learning are owned by Tutera Learning LLC or its licensors unless otherwise stated.

You may use our Services for their intended educational and personal purposes.

You may not, without appropriate authorization:

  1. Copy or reproduce our protected materials.
  2. Modify or distribute our platform materials.
  3. Sell or commercially exploit our content.
  4. Use our branding without permission.
  5. Attempt to extract or reproduce platform software.
  6. Use our content to create a competing service where prohibited by law.

Tutors retain ownership of teaching materials they independently create or lawfully use, subject to the license granted to Tutera Learning under these Terms.

We do not guarantee:

  1. A particular grade.
  2. A particular test score.
  3. Admission to a school, college, university, or program.
  4. Completion of a course.
  5. A specific academic or professional outcome.
  6. A particular learning result.

Tutor profiles and educational information are provided to help users evaluate available tutoring options.

19. Disclaimer of Warranties

To the extent permitted by law, the website and Services are provided on an "as is" and "as available" basis.

We do not guarantee that:

  1. The Services will always be available.
  2. The platform will operate without interruption.
  3. The platform will always be error-free.
  4. Every tutor will be suitable for every student.
  5. User-provided information will always be accurate.
  6. Third-party services will remain available.
  7. A tutoring session will produce a particular result.

Nothing in these Terms excludes rights or protections that cannot legally be excluded.

20. Limitation of Liability

To the maximum extent permitted by applicable law, Tutera Learning LLC will not be responsible for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including loss of data, revenue, business opportunities, or expected educational results.

Tutera Learning is not responsible for the independent actions, conduct, representations, or omissions of users, including tutors and students.

To the extent permitted by law, our total liability arising from your use of the Services will be limited to:

Nothing in these Terms limits liability that cannot legally be limited or excluded.

21. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Tutera Learning LLC, its affiliates, officers, employees, contractors, and service providers from claims, liabilities, damages, losses, and expenses arising from:
